Cezasızlığın meşruiyeti

 

Burası bir hesapvermezlik diyarı mâlum. Hesapvermezlik, cezasızlık ve cürmün yanına kâr kalması memleketin genlerine işlemiş. Bu sefer büyük resmi sade kendileri görebilen sorumluluk sahibi zevat 17/25 Aralık 2013 soruşturmasını “net hata noksan” hanesine yazmak üzere kolları sıvamış görünüyor. Adına rövanş dedikleri hesaplaşma olmasın, unutalım gitsin der gibiler. Gerekçeleri, seçmen 7 Haziran’da güya “öpüşüp koklaşın, barışın, bi hükümet kurun işte, millî huzuru tesis edin” demişmiş. Tayyip Erdoğan’ın son 5-6 yıldır gergef gibi gerdiği, hep infilâk etme raddesinde bir insan topluluğunun huzur arayışında olması gayet doğal. Ancak ne pahasına olursa olsun mu acaba? Huzura erişmenin yolu kamuya verilen zararı, hukuk sisteminde yapılan tahribatı, zedelenen toplum vicdanını görmezden gelmek mi? Yoksa o mumla aranıp da bulunamayan huzurun sebebi, bir türlü iflah olamamamızın nedeni tam da bu görmezden gelme ve dolayısıyla yapanın yanına kâr bırakma âdeti olmasın sakın? Ahlâksızlığın, pişkinliğin ve yüzsüzlüğün daima yüzleşmeye tercih edildiği, hatta bu davranışların birer kamusal hayat tarzı hâline geldiği bir diyar değil mi burası? 1915’den bu yana… Soykırım gibi devasa bir suçla yüzleşilemeyen, aksine suçun üstü utanmazca örtülen yerde yolsuzluğun lafı mı olur.

 

Bugünkü meşrulaştırma çabası toplumsal feryadın marazî bir okumasıdır. Demokrasinin de öyle. Türkiye gibi az gelişmiş ülkelerde demokrasi uzlaşma ve çatışmasızlık sistemi sanılır. Hasımlıkları unutalım, aklıselim sahibi olalım ve bu hedeflere ulaşmak için özellikle geçmişle hesaplaşmayalım. Çünkü belki kimse temiz değil…1915’ten itibaren sayarsak üst üste yığılan yüz yıllık bir hesaplaşamama tarihidir bu. Ve o ölçüde çürümenin tarihi. Yunanistan’la nüfus mübadelesi, Nesturî ayaklanması, namütenahi inkılâp dayatmaları, art arda Kürt isyanları, Anadolu’da Gayrimüslim ibadet ve eğitim kurumlarının kapatılması, Trakya-Çanakkale pogromları, Dersim Tertelesi, 6-7 Eylül pogromu, 27 Mayıs askerî darbesi, 1964 Rum sürgünü, 12 Mart askerî darbesi,  Kıbrıs’ın işgâli, 12 Eylül askerî darbesi, Kürdistan içsavaşı ve bunlara ilâveten daha nice hesabı verilmemiş ekonomik, sosyal, ekolojik cürüm… “Halkımızın sağduyusu” namına geçiştirilmiş, “net hata noksana” yazılmış dünyalar kadar ihlâl ve dünyalar kadar adalet beklentisi.

 

Sistemin nimetlerinden istifade etmek uğruna hukuku ayaklar altına alarak unutmak,  suçortaklığı demek olan uzlaşmalar aramak, sorunları ötelemekten ve onları biriktirmekten başka bir şey değildir. Bugün dönüp dolaşıp dayandığımız duvar yine bu “hukuksuzluğa meşruiyet kılıfı arama” duvarıdır. Ağlama ya da yüzleşme duvarı değil… Diğer tarafta gerçek bir demokraside maharet, doğal olarak siyasete taşınan ihtilafları azdırmamak, normalleşmelerine zemin hazırlamak, onları doğru yöneterek bunların çatışmaya ve kutuplaşmaya dönüşmesini engellemektedir. Bugünlerde işittiğimiz gibi istikrar adına bunları reddetmekte değil. Zira huzur arayışı, itidal ve üslupta sükûnet başka, illa ki uzlaşma başka.

 

CHP/MHP muhalefeti ve istikrar adına “unutalım gitsin” demeye getirenler ormana bakmaktan ağaçları göremez durumda. Siyasetçilerin devasa hukuksuzluk ağaçlarını göremiyor olmaları hesapvermezlik kültüründen, diğerlerinin istikrar, huzur, uzlaşma sevdası ise sakat bir demokrasi okumasından… Sonuç: ileriye bakmaktan önünü görmeyen bir siyaset ve sesini bir türlü duyuramayan bir toplum…
