Judge rules emoji are proof of intent

A landlord in Israel has successfully sued a couple who mislead him with emoji, with the judge ruling that the tiny pictures constituted a statement of intent. The landlord, Yaniv Dahan, posted an ad on a classified site for his home, and received a response from a couple. After giving him the impression they wanted to rent the house, he took down the ad — and then the couple stopped responding to his texts.
Chelsea Manning took her first steps as a free woman moments ago. Charged with espionage and the capital offense of aiding the enemy, she faced a 35 year sentence for 20 charges, stemming from classified information the then-Bradley Manning submitted…

Emojis are more than a series of smileys and other funny faces abundantly used by teenagers on social networks. These tiny, little pictograms offer an entirely new, more visual way to express complex concepts and are used more and more often by world leaders and diplomats on social media.

In some ways, the biggest news of the week was not the Panama papers but the announcement that WhatsApp was rolling out end-to-end encryption for all its 1bn users. “From now on,” it said, “when you and your contacts use the latest version of the app, every call you make, and every message, photo, video, file and voice message you send, is end-to-end encrypted by default, including group chats.”

The internet, and social media in particular, has powerful tool for raising awareness for social causes and charity events. Non-government organizations (NGOs) have also adapted to the digital age and use technology to communicate with supporters and donors.

However, according to a report from nonprofits Tech For Good and Public Interest Registry, there is a gap between the use of internet and social platforms by NGOs in Western nations and those in developing nations.

The European Commission’s plan to introduce EU-wide binding refugee quotas appears to be falling to pieces already after France and Spain voiced their criticism.

In reaction to the refugee tragedies, the EU foreign ministers on Monday agreed to launch a naval mission in the Mediterranean. Pending a corresponding UN mandate, the mission will begin destroying smugglers’ boats as of June. The operation is worth a try, some commentators believe. Others criticise that it will only fight the symptoms of the crisis rather than the causes.

The EU’s foreign ministers are planning a naval mission in the Mediterranean, while the European Commission has proposed a quota system for distributing refugees which has met with opposition from a number of member states. Europe must use force if necessary to stop the mass immigration of economic refugees, some commentators urge. Others describe this policy of shutting Europe’s doors to refugees as inhumane.

Those who doubted the potential of the European Union’s Council Regulation 1005/2008 (the IUU Regulation) to change the laissez faire culture that has been prevalent for too long in respect of illegal, unreported and unregulated (IUU) fishing activities inside and outside EU borders have had plenty of food for thought over the past four and a half years. In the time since the IUU Regulation came into force, the yellow card warning system, followed up on occasion by a trade-suspending red card, have seen a significant change in the administrative practices of a number of fish producing countries.  Most importantly, the IUU Regulation has placed IUU fishing high in the agendas of nations that had previously not been predisposed to delve into the issue.

Türkiye 7 Haziran akşamına kilitlendi. 8 Haziran sabahı “yeni” ve başka bir Türkiye’ye uyanmak istemeyen bir kişi yok. Herkes değişim beklentisi içerisinde, AKP’liler dâhil.  Erdoğan ve AKP’den kurtulmak isteyenler kadar şu sırada yaşadığımız “Erdoğan usulü” fiilî başkanlık rejimini anayasal güvence altına almak isteyenler de değişim peşinde. Oysa Türkiye kolay değişen bir yer değil. Aşırı özgüven tuzağına düşmemek gerek.

 

Sonuç ne olursa olsun bir kaos dönemine gireceğimiz kanaatindeyim. HDP’nin barajı geçmesi halinde HDP ve Kürt siyasî hareketi Türkiye’nin anamuhalefeti olduğunu perçinleyecek. Yeri gelmişken, HDP’nin (BDP’nin) bundan böyle anamuhalefet olduğunu geçen seçim sonrası 17 Haziran 2011’de yazmışım. Seçim kampanyasında HDP’nin Erdoğan ve AKP politikalarına karşı geliştirdiği dil anamuhalefet dilidir. HDP’nin barajı aşmasının memleketin siyasî ortamına getireceği yeni nefesi hissetmek zor değil. Siyasî alışkanlıkları, hâkim unsurun pederşâhî zihniyetini, ahlâkçı sağ siyaseti altüst edebilecek bir nefes olur bu. Üstelik Türkiye’de baraj varolduğundan beri barajı zorlayarak siyasete böylesi bir meşruiyetle dâhil olabilmiş bir parti olmadı. Ama bütün bunlar daha ilerisi için, 8 Haziran sabahı için mesele bu değil.

 

Herkes aşağı yukarı iki olasılık üzerinden senaryo üretiyor. İlki Erdoğan’ın muradına ermesi,  diğeri muradına erememesi; ama her iki durumda da kaos. Erdoğan’ın muradına ermesi HDP’nin baraj altında kalması demek. Barajı aşamadığı ya da hileyle HDP’ye baraj aştırılmadığı takdirde olabilecekleri gözden geçirelim. Demirtaş’ın barışa sadakat ve Türkiyelilik taahhütlerini yerine getirmek, hareket içi dengelerle bağlantılı olarak merkezkaç eğilimlerin baskın gelmesiyle kolay olmayabilir. Hareketin daha Kürdistanî mecraya çekilmesi ihtimal dâhilinde. Ancak bu çekilme huzurlu olmayabilir. Sonrasında bölgede güvenlik güçleriyle ve Batı’da Kürt olmayan unsurların Kürtlerle yaşayabilecekleri gerginlik olasılıklarına mim koymak gerekiyor.

 

Yine de alacağı sandalyeye göre kalıcı olmasını sağlayacak formüller farklı. Anayasal çoğunluk 367’yi bulması HDP baraj altında kalsa dahi çok zor görünüyor. Başkanlık sistemini referanduma götürmesini sağlayacak 330 daha olası. Ancak bu hiçbir kazanma garantisi olmayan bir oylama ve yine gerginlik demek. Üstelik Kürtlerin baraj sınırı altında kalıp hiçe sayılacakları ve bölgeye çekilecekleri zor bir ortamda. Üstelik toplumun çoğunluğunun karşı olduğu bir AKP’nin yeniden tek başına hükümet kuracak olduğu bir durumda. Ekonomide nereden aktığı belli olmayan taşıma sular dışında yeni bir hikâye yazmak mümkün değilken. İçerde ve dışarıda tıkanmamış tek bir politika yok iken.

 

HDP’nin barajı aşması ise AKP’nin 330’u hatta kimi araştırmalara göre tek başına hükümet kurabilmek için 276 sandalye dahi bulamayacak olması demek. Ama aynı zamanda Erdoğan’ı azamî esirgeyecek şekilde 276’yı ve 330’u bulabilmek için başka parlamenter formüller araması demek. Bu formüller gerçekleşebilir ama bir şartla: Erdoğan gölgesinde varılacak her mutabakatın AKP’ye bir biçimde ortak olacak diğer partiyi seçmeni ve kamuoyu gözünde ne duruma düşüreceğini hesaba katarak.

 

Türkiye’de siyasetin Erdoğan’ın dolaylı veya doğrudan içinde olacağı bir denklemi sindirmesi ne kadar mümkün artık? Sadece siyasetin mi? Futboldan dış ilişkilere, dinî itikattan inşaata, çocuk sayısından anayasal hükümlere, hukukun işleyişinden medya özgürlüğüne, Gayrimüslim politikasından faiz politikasına, müdahil olduğu her konu bir reel veya potansiyel fiyasko demek değil mi?

 

Türkiye seçime gidiyor gözükse de Erdoğan’ın muradı dışında seçimin hiçbir mana ve ehemmiyeti yok. Her sözün, her fillin Erdoğan’ın istikbaliyle belirlendiği bu ortam siyasetin sıfır noktasıdır. HDP’ye saldırılar ve seçim kampanyasının sefilliği kaosun öncülleri değil mi zaten?
